{"id":46497,"date":"2025-01-22T13:51:58","date_gmt":"2025-01-22T18:51:58","guid":{"rendered":"https:\/\/mjtsai.com\/blog\/?p=46497"},"modified":"2025-02-26T15:14:42","modified_gmt":"2025-02-26T20:14:42","slug":"app-store-trader-status-deadline","status":"publish","type":"post","link":"https:\/\/mjtsai.com\/blog\/2025\/01\/22\/app-store-trader-status-deadline\/","title":{"rendered":"App Store Trader Status Deadline"},"content":{"rendered":"<p><a href=\"https:\/\/developer.apple.com\/news\/?id=einwn76m\">Apple<\/a>:<\/p>\n<blockquote cite=\"https:\/\/developer.apple.com\/news\/?id=einwn76m\">\n<p>Starting February 17, 2025: Due to the European Union&rsquo;s <a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/priorities-2019-2024\/europe-fit-digital-age\/digital-services-act_en\">Digital Services Act<\/a>, apps without trader status will be removed from the App Store in the European Union until trader status is provided and verified, if necessary.<\/p>\n<\/blockquote>\n\n<p><a href=\"https:\/\/developer.apple.com\/help\/app-store-connect\/manage-compliance-information\/manage-european-union-digital-services-act-trader-requirements\/\">Apple<\/a>:<\/p>\n<blockquote cite=\"https:\/\/developer.apple.com\/help\/app-store-connect\/manage-compliance-information\/manage-european-union-digital-services-act-trader-requirements\/\"><p>To determine if you&rsquo;re a trader, you should consider a range of non-exhaustive and non-exclusive factors (see those listed on page 2 in the EC&rsquo;s Guidance), which may include:<\/p><p>Whether you make revenue as a result of your app, for example if your app includes in-app purchases, or if it&rsquo;s a paid or ad-sponsored app &mdash; especially if you&rsquo;re transacting in large volumes<\/p><p>[&#8230;]<\/p><p>Whether you develop your app in connection with your trade, business, craft, or profession&mdash;meaning that you&rsquo;re acting in a professional\/business capacity. You&rsquo;re unlikely to be a trader for EU law purposes if you&rsquo;re acting &ldquo;for purposes which are outside your trade, business, craft, or profession.&rdquo; For example, if you&rsquo;re a hobbyist and you developed your app with no intention of commercializing it, you may not be considered a trader.<\/p><\/blockquote>\n<p>When I looked at this last year, it seemed like <em>anyone<\/em> selling apps would be considered a trader. This guidance from Apple adds <a href=\"https:\/\/mastodon.social\/@simonbs\/113859578289950048\">confusion<\/a>: what is a <em>large volume<\/em>? What does it mean to offer an app for sale <em>with no intention of commercializing it<\/em>?<\/p>\n\n<p><a href=\"https:\/\/mastodon.social\/@vandal\/113845075891424045\">Luc Vandal<\/a>:<\/p>\n<blockquote cite=\"https:\/\/mastodon.social\/@vandal\/113845075891424045\">\n<p>Still receiving this (again) despite confirmation that the status for my account is fine. I sent them the documents last March. They didn&rsquo;t process them in time, and they expired. So, I get in contact and get assigned an issue number and person assigned to the issue, pay for up-to-date docs, and send them again. Silence.
