{"id":29860,"date":"2020-08-24T17:02:55","date_gmt":"2020-08-24T21:02:55","guid":{"rendered":"https:\/\/mjtsai.com\/blog\/?p=29860"},"modified":"2020-09-11T15:01:16","modified_gmt":"2020-09-11T19:01:16","slug":"microsoft-supports-epics-injunction","status":"publish","type":"post","link":"https:\/\/mjtsai.com\/blog\/2020\/08\/24\/microsoft-supports-epics-injunction\/","title":{"rendered":"Microsoft Supports Epic&rsquo;s Injunction"},"content":{"rendered":"<p><a href=\"https:\/\/www.macrumors.com\/2020\/08\/23\/microsoft-supports-epic-games-vs-apple\/\">Joe Rossignol<\/a> (also <a href=\"https:\/\/news.ycombinator.com\/item?id=24253943\">Hacker News<\/a>):<\/p>\n<blockquote cite=\"https:\/\/www.macrumors.com\/2020\/08\/23\/microsoft-supports-epic-games-vs-apple\/\"><p>In a court filing [<a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.cand.364265\/gov.uscourts.cand.364265.43.0.pdf\">PDF<\/a>] today, Epic Games said that multiple Unreal Engine licensees have contacted the company &ldquo;expressing grave concern over Apple&rsquo;s actions and its impact on their iOS and macOS-bound projects,&rdquo; including Microsoft.<\/p><p>In a declaration in support of Epic Games [<a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.cand.364265\/gov.uscourts.cand.364265.40.0.pdf\">PDF<\/a>], Microsoft gaming executive Kevin Gammill wrote that &ldquo;Apple&rsquo;s discontinuation of Epic&rsquo;s ability to develop and support Unreal Engine for iOS or macOS will harm game creators and gamers.&rdquo; Specifically, Gammill said that games utilizing Unreal Engine will be put at a &ldquo;substantial disadvantage,&rdquo; citing Microsoft&rsquo;s own racing game Forza Street for iPhone and iPad as an example.<\/p><\/blockquote>\n\n<p><a href=\"http:\/\/www.fosspatents.com\/2020\/08\/microsoft-supports-epic-games-quest-for.html\">Florian Mueller<\/a>:<\/p>\n<blockquote cite=\"http:\/\/www.fosspatents.com\/2020\/08\/microsoft-supports-epic-games-quest-for.html\"><p>However, what Mr. Gammill&rsquo;s declaration doesn&rsquo;t explain is why Epic couldn&rsquo;t live and comply with the Apple Developer Agreement it had been gladly and (very) profitably honoring for years. In that case, Epic&rsquo;s Apple Developer Agreement wouldn&rsquo;t be terminated, and the further development of the Unreal Engine wouldn&rsquo;t be affected by the ongoing litigation.<\/p><p>[&#8230;]<\/p><p>Based on today&rsquo;s declaration it&rsquo;s clear where Microsoft stands, and it&rsquo;s not hard to figure out why, but the above declaration really doesn&rsquo;t strengthen Epic&rsquo;s case for a TRO.
